There seems to be a great deal of confusion over the types of tax sales and auctions available. The endless list of names I have found investors using is mind boggling. This is why I choose to address this issue here, at the beginning. It will make further information and pages easier to understand if we are using the same terms.

Common name: Tax Sale

What is it: Refers to all sales and auctions in a given area conducted by county Tax Collectors.

Common names: Tax Lien Sale, Tax Lien Auction, Tax Lien Certificates, Tax Certificate Sales, Tax Auction, tax sale certificates

What is it: Usually refers to the annual auction of tax certificates conducted by every Florida County on or before June 1st. Tax certificates are offered by the county Tax Collector as a means of collecting delinquent taxes owed for the previous year. You can access auction information on the Tax Collectors website, usually they are listed as a tax certificate sale and advertised as legal notices.

Common Names: OTC Sales, Over The Counter Tax Liens, County Held Certificates, Certificates Struck Off To The County

What is it: Usually refers to those certificates available at any time throughout the year offered by a county Tax Collector. These certificates were unsold at previous tax certificate auctions. In most counties, the Tax Collectors website lists these certificates as “County held Certificates” or “Certificates Available”.

Common Name: Tax Foreclosures

What is it: Refers to tax deed auctions conducted by the Clerk of Circuit Courts. The Clerk’s Office or Tax Deeds Office (depending on county size and resources) will typically list these auctions as “Tax Deed Sales”. Some Clerks list these sales under a general heading of foreclosures. It is nice to see Levy County no longer includes tax deed sales under Human Resources on their site (now they are under Other Divisions). Tax deed sales must be advertised in a newspaper as a legal notice for application of tax deed.
