FYI-A tax foreclosure results in the issuance of a tax deed, these terms are commonly used interchangeably.

Tax Foreclosure Background:

The county government issues a lien against that property which there has been no taxes received. That lien is conveyed to an investor as a tax certificate. Once the tax certificate “lien” has been held for 2 or more years the holder of the certificate can enforce the lien. The enforcement is referred to as a tax foreclosure. A tax foreclosure results in the issuance of a tax deed.

The process of foreclosing on the lien requires an application for the tax deed to be submitted to the county. The application is, by itself, nothing more than a means for the tax deed to be issued. Once the application process has been completed by the county, a tax deed sale “auction” will occur.

What is a Tax Deed:

A tax deed is a conveyed ownership interest in a property conveyed to you from the County Clerk of Circuit Courts. The ownership interest is not exclusive; the names of prior owners are still attached to the property. It is for this reason you can not currently receive title insurance on a tax deed ownership interest. In essence you are joined in ownership of the property with the previous owners.

Once you have obtained an ownership interest “tax deed” on a property you have two ways of obtaining a clear and marketable title, eligible for title insurance, which is called a fee simple ownership.

To obtain fee simple ownership you must:

  • satisfy all debt, liens, judgments and mortgages against the property (superior liens and judgments will have to be satisfied through payment or negotiation)(inferior liens,judgments will need to be stricken or removed)(all previous owners and parties of interest will need to be removed from making claim upon the property)
  • by completing one of the following;

  • hold the tax deed for 4 years unchallenged, while paying taxes
  • or

  • file a court action to Quiet the Title, which will remove clouds of ownership and parties of interest in the property. By naming as Defendants, in a Quiet Title Action, those parties claiming interest in and owners of the property they can be removed. This process can typically be completed in 45 days-3 months.

Tax-Foreclosure Investing Future

At the current time all tax foreclosure “tax deed” sales are held by the county at the courthouse, but times are changing. As of 2008, a law change has enabled the counties to conduct tax foreclosure “tax deed” sales online and some corporations such as Grant Street Group are rallying for their business.

Much like tax certificate sales "auctions" I expect within 2-3 years that the larger counties will be conducting all of their auctions (tax certificate, tax deed, bank foreclosures) online.

Property Ownership at a substantial discount! Here is a 1.6 acre commercial/multifamily zoned piece of land buildable to 3 stories with lake view. We purchased for $4,500 at a tax deed sale which has a 2008 assessment of $87,000. While this is not the norm, it still feels good. I would normally expect to invest 30-40% of value for a tax deed property.
