Home Owners Association Question??

I got your name from a friend of mine who thought you might be able to answer my question. I live in Florida and have lived in my house for 9 years. The homeowner board wants to pass a law that no one can rent their house. For those of us opposed to this, is there any Florida law that makes it illegal for an HOA to pass this rule? If so, can you tell me where to find the law?

Kristina, To my knowledge the statutes restricting the inclusion of or mandating changes to structured bylaws set forth by the Home Owners Association can be found within the statutes/chapters listed below. As far as I know, the board must pass or reject the proposal by majority vote AND get a majority vote of the members of the home owner’s association. If the board can achieve this then they will get what they want. It is difficult for such a bylaw to be passed after the covenants of the home owner's association are set in stone as it is very difficult to achieve a majority vote when it hinders people’s ability to do as they please. Some will vote against it as they feel it hinders their personal rights and others will vote against it as they have rented their units. When you became a member of the association you agreed to adhere to the rulings of the association, get a copy of the bylaws/covenants from the association or copy from the official records at the court house.
