ForeclosureInfo: Case Files
A case file, once retrieved as described on prervious page, contains vital information necessary to make your judgment call. You will need this information for comparison and analysis against the information found at the Property Appraisers office.
What you need from the file:
- Official book and page numbers of: liens, mortgages, judgments and amount of each
- Dates executing the above documents
- Amount of foreclosure judgment
- Legal description of property
- Names of Grantors/Grantees on deeds and or conveyances
Note: Read every document in the foreclosure file, sometimes documents get out of order and you don't want a simple error to be made.
Before you return the file there are two easy steps to making your future title research for this property easier.
Create a chain of title:
A chain of title is the sequence of historical transfers of title to a property. The"chain" runs from the present owner back to the original owner. In our situation, back to the earliest title in the case file.

In the above example Rachel Gomez is the current owner, Grantee=EE is Buyer, Grantor=OR is Seller, chain ends with earliest conveyance.

If you can't create a superiority checklist for the property get a different file. A mistake in your checklist could cause your downfall.
Make sure you write down the exact legal description for the property.
There has recently been some new law changes which affects what survives the issuance of a tax deed and certificate of title so you tax deed, mortgage foreclosure and certificate investors out there will definately want to have this important update to my information.

ForeclosureInfo: Using Property Appraisers Data
From the Property Appraisers home page, in most counties, you can run a query by owner name or legal description. Once the correct data card is found compare the properties value against those liens and judgment amounts found in the foreclosure file. If the total dollar amount in the file is significantly less than the properties value seek out the plat map. Most counties have access to aerial plats so you can identify the area, look for homes and values of surrounding homes. Most counties allow you to overlay recent sales data of the surrounding area to the aerial map. How does your perspective property hold up? Is the sales data and values of those properties comparable to yours? If you find the area sales are considerably more than the foreclosure amount plus superior liens, write down the addresses of the comps, print out the map, write in the data of the comparable properties (size, year built, assessed value, price sold, features) and go back to the data card for your prospect.
Back at the Property data card take note of the book and page of conveyances of the property. Most property data cards will contain the recent sales of the specific property. Do the book and page numbers of conveyances match the book and pages pulled from the foreclosure file, if so thats good. If not, I would recommend the new foreclosure investor seek a new prospect.
There are a number of functions which can be performed and it varies by county. Some plat maps allow overlaying of health department data, so you can see septic system requirements, topographical overlays for elevation, public works overlays for municipal water lines, etc. Some counties allow non mapping sales records searches by subdivision or street. The most importantant data from this location is the comp data.
Important data from the Property Appraisers office: prospect property address, features, values, property identification number, owner contact information, map and comp information.
ForeclosureInfo: Using Tax Collectors Data
Most counties allow a tax records search from the home page of the Tax Collector. You will need the owners name, or tax id number. Typically there will be at least one year of unpaid property tax which will be in need of paying. In many counties if there is more than one year of taxes due you will have to call to get the tax payoff amount. If the property owner seems to have considerable equity in the home you may be better off to contact direct instead of waiting for the auction.
