The Truth IS: Everything foreclosure starts and ends with county records and you can bank on it!



Why Is Subscription Data Out Of Date?
Locating pre foreclosures and potential short sale properties requires stealth, forget about subscription services, by the time they are posted they are typically gone. I know this as fact as I purchased 13 properties at a single auction and 2 weeks later they were listed on a popular subscription site as preforeclosures. It comes down to a simple term, macros. A macro is a computer program used to data mine the county websites, extracting the data and populating fields on websites, spreadsheets or documents. You then pay for access to the website or spreadsheet. Remember the Secret Treasure Chest of Tax Deed Properties on the infomercials a few years back, well people payed big bucks for access. You payed for monthly individual spreadsheets meanwhile the infomercial guy was buying his info in bulk from a compiler out of Irvine California, I believe. The price difference was quite impressive. The compiler was running a computer program which extracted the data and populated the fields. It is now possible to do this yourself and is relatively inexpensive, check out Imacros.

Because these programs are so darned good at getting the data, it creates a lot of spreadsheets or room on someone's website so they run the program in intervals maybe every month or 2 weeks in order to keep it managable. In between intervals, you are looking at dated information.

If you want the most direct line you have to go to the source. When a property owner is in default a notice is entered into the counties official records. The notice is entered by the attorney representing the lender, Plaintiff, and is recorded in the county of which the property is situate. In Florida the first documents to be recorded are the "Notice Of Action" and the "Lis Pendens" and it is the first notice to be entered in a foreclosure case. Both of these items are recorded on the same day. You can't currently search by Notice of Action but you can query the official records by Lis Pendens. Access to the official records in all Florida counties can be accessed for free from here

You can also go to the County Clerk of Circuit Courts Website or office and search the official records. You will want to query the term Lis Pendens and run the query date restricted. I usually run my search in 7 day intervals. This will give you a list of perspective property owners to contact. The owners and parties holding interest in the porperty will be listed as Defendants. Also keep note of the properties legal decription and the case number.

You will then need to query those named Defendents gathered with the records of the Property Appraiser in that county.

The Property Appraiser's records will give you the features of the property, address of owners, assessed values and in most counties a GIS map of the property. You can then create a GIS overlay to show all kinds of neat things such as area sales.

Once you have located a property you are interested in go back to the Counties Official Records and run a query by owners names and legal description of property. This will reveal other potential downfalls of the property such as mortgages outstanding, liens, encumbrances, etc, etc.. This is the basis of how a chain of title is created and how a title researcher conducts research for issuance of title insurance.

If you live in the area of the homes you are looking at, you can always forego a lot of the computer hunt and peck by going to the Clerk of Circuit Courts Office and pulling the foreclosoure file though I would still strongly suggest creating a chain of title and doing the official records due diligence before contacting people it will save a lot of time. And, in the foreclosure file the O&E owners and encumbrance report can be found which will list all of the owners and parties. But, depending upon when the report was generated there may be new things added in the official records that aren't in the file such as liens.

Final Notes
In Florida the files are stored according to case number and the case number will be on the top right hand corner of the Lis Pendens or you can get the case number from the legal advertisement in the newspaper. There is a newspaper of general circulation which will be contracted with the county for running legal ads and will also run the attorney's ads as well. If you don't know which paper it is, contact the Clerk of Circuit Courts and ask.

As more counties have mortgage foreclosure auctions online, there is less need for retreival of the foreclosure file at the Clerk's Office as all docs in the file are linked to the case number through the auction.
